1. Acceptance of Terms

By downloading, installing, or using CarBOS Pro (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

CarBOS Pro is a document generation application that assists users in creating bills of sale for private vehicle transactions. The App generates documents incorporating electronic signatures pursuant to the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA).

3. Not Legal Advice

CarBOS Pro is a document preparation tool only. Nothing in this App or its generated documents constitutes legal advice. We are not attorneys and do not provide legal services. Vehicle title transfer requirements vary by state and jurisdiction. You are solely responsible for ensuring compliance with all applicable laws in your jurisdiction, including but not limited to title transfer filings, odometer disclosure requirements, and sales tax obligations.

We strongly recommend consulting a licensed attorney or your state’s Department of Motor Vehicles for guidance on your specific transaction.

4. User Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information and to update it as necessary.

5. In-App Purchases

The App offers a one-time purchase of $1.99 USD to unlock electronic signatures and finalize each bill of sale. This fee is charged per transaction. Purchases are processed through Apple App Store, Google Play, or Stripe depending on your platform.

All purchases are final. Refunds are governed by the platform through which you made your purchase (Apple, Google, or Stripe). We do not issue refunds for completed transactions where the document has been signed by both parties.

6. Electronic Signatures

By signing a document within the App, you agree that your electronic signature is legally binding and has the same legal effect as a handwritten signature, pursuant to the ESIGN Act and UETA. You represent that you have the authority to sign the document and that all information provided is accurate to the best of your knowledge.

7. User Responsibilities

You agree that you will not use the App to:

• Create fraudulent, false, or misleading documents
• Impersonate any person or entity
• Transfer vehicles with undisclosed liens or encumbrances
• Violate any applicable federal, state, or local law
• Engage in any activity that could harm other users or third parties

8. Accuracy of Documents

You are solely responsible for the accuracy of all information entered into the App. CarBOS Pro does not verify the accuracy of VIN numbers beyond NHTSA database lookup, sale prices, odometer readings, or the identity of any party to a transaction. Any errors or omissions in the generated document are your responsibility.

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CarBOS Pro SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE APP OR ANY DOCUMENT GENERATED THROUGH THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by applicable law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the App or email. Continued use of the App following such notification constitutes acceptance of the updated Terms.
